Helping the Warehousing Sector Clarify COMAH Applicability for Lithium-Ion Battery Storage

The Problem

A business in the warehousing sector was storing lithium-ion batteries in significant quantities and needed to understand whether this brought their operation under the scope of the COMAH regulations. The uncertainty created potential for unnecessary regulatory burden, cost, and delay in operational planning.

We were hired due to our ability to provide quick, clear and practical advice to determine whether COMAH applied, and if not, what other regulatory frameworks they should be aware of.

My Approach

Regulatory thresholds and guidance were reviewed in relation to the specific quantities and types of lithium-ion batteries stored. The assessment considered both the chemical composition and the operational context of the storage setup.
It was determined that the operation did not fall within the scope of COMAH, based on how the materials were classified and managed. Additional advice was provided on other applicable regulations to ensure the business remained compliant without taking on unnecessary obligations.
